Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the EI Coaching Birmingham website (the "Site") and its coaching services (the "Services"), operated by EI Coaching Birmingham ("us," "we," or "our"). By accessing or using the Site and Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site or use the Services. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
1. Use of Our Site and Services
You agree to use our Site and Services only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Site. This includes all materials provided during coaching sessions, workshops, and any downloadable resources.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site or provided through our Services. Our content is not for resale. Your use of the Site or Services does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You may use protected content solely for your personal and non-commercial use in connection with our Services.
3. Coaching Services
Our coaching services are designed to support entrepreneurs in developing their emotional intelligence, enhancing emotional stability, and improving adaptability. Coaching is a partnership between the coach and the client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
Coaching is not therapy, counseling, or psychotherapy. While coaching can address personal and professional challenges, it is not a substitute for professional mental health care or medical advice. By engaging in our coaching services, you acknowledge that you are fully responsible for your own decisions, actions, and results, both during and after the coaching program. We commit to providing our services with professionalism and care, but we do not guarantee specific outcomes or results, as these depend heavily on your individual effort and commitment.
Details regarding specific coaching packages, session duration, frequency, fees, and payment terms will be outlined in a separate coaching agreement provided to you before the commencement of any paid services. Cancellation, rescheduling policies, and confidentiality terms will also be explicitly stated in this agreement. All information shared by you during coaching sessions will be kept confidential, except where disclosure is required by law or if there is an imminent risk of harm to yourself or others.
4. Limitation of Liability
To the fullest extent permitted by applicable law, EI Coaching Birmingham, its affiliates, officers, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
Our total liability to you for any claim arising out of or relating to these Terms or the Services, regardless of the form of the action, will be limited to the amount you paid, if any, to us for the Services giving rise to the claim during the three (3) month period preceding the date the claim arose. The limitations of damages set forth above are fundamental elements of the basis of the bargain between EI Coaching Birmingham and you.
5. Disclaimer of Warranties
The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis. EI Coaching Birmingham expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service will be uninterrupted, timely, secure, error-free, or that defects, if any, will be corrected. You acknowledge that you access the Site and use the Services at your own risk.
No advice or information, whether oral or written, obtained by you from EI Coaching Birmingham or through the Services shall create any warranty not expressly stated in these Terms. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. We are not responsible for any decisions made by you based on information or insights gained through our coaching or website content.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, which may include posting a notice on our Site or sending an email to registered users. What constitutes a material change will be determined at our sole discretion. Your continued use of the Site or Services after such modifications will constitute your: (a) acknowledgment of the modified Terms; and (b) agreement to abide and be bound by the modified Terms.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes, actions, claims or causes of action arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
